Generally, FFAI collects, uses, and discloses personal data for the following purposes:

1. To carry out our daily business operations, including processing transactions, managing your account, sending SMS and emails, and other essential documents required for the continued use of our products and services.
2. To perform identity verification and customer due diligence in compliance with Philippine regulations and applicable laws, including the prevention of money laundering as mandated by the Anti-Money Laundering Act of 2001, as amended.
3. To respond to court orders, directives, and requests from local or foreign authorities, including regulatory, governmental, tax, and law enforcement agencies.
4. To comply with the laws of the Philippines and relevant foreign jurisdictions.
5. To fulfill contractual and regulatory obligations, including the submission of data to credit bureaus, credit information companies, and the Credit Information Corporation, in accordance with the Credit Information System Act.
6. To conduct studies and research aimed at reviewing, developing, and improving our products and services, including monitoring and recording calls and communications.
7. To adhere to our operational, audit, administrative, credit/risk management processes, and other internal policies and procedures.
8. To address, process, and manage your inquiries, requests, feedback, suggestions, and complaints.

The types of personal data we collect and share vary depending on the product or service you have with us. We gather your personal data when you interact with our employees and authorized representatives across our business partners, social media platforms, and other electronic channels. This may include, but is not limited to:

1. Basic personal details such as your name, date of birth, gender, marital status, and citizenship, along with supporting documents like government-issued ID information.
2. Specimen signatures
3. Your contact information, including your home address, mobile number, education, employment, and business details, and telephone numbers.
4. Photos via camera to complete your application when applying to our products and services when visiting to our business partner store.
5. Financial details, including income, expenses, balances, investments, taxes, insurance, and financial and transaction history.
6. Credit information
7. Voice recordings of conversations between our agents and you.

We collect personal data from you in various ways, such as when you complete a form, make a call, submit records and official documents, undergo background and credit checks related to a potential business relationship, or interact with us through social media platforms and other electronic channels. Below are the ways in which we may collect personal data from you:

1. When you submit any form, including but not limited to application forms or other forms related to our products and services you make through FFAI.
2. When you interact with our staffs, including collection agents, managers, and sales agents, through methods such as telephone calls (which may be recorded), in-person, and emails.
3. When you enter into any agreement or provide documentation or information related to your transactions with us, or when you use our products and services.
4. When your photos are captured by us via device cameras while you are applying to our products and services.
5. When you use certain products and services offered through online and other technology platforms, such as websites and apps.
6. When you are contacted by and respond to our marketing representatives, sales agents, and collection agents.
7. When we obtain information about you and receive your personal data from third parties in relation to your relationship and transactions with us, such as from referrers, business partners, external agency, public agencies, or relevant authorities.
8. When you request us to contact you, include you in an email or mailing list, or respond to our request for additional personal data, promotional campaigns, and other marketing activities.
9. In connection with any investigation, litigation, or inquiry that may involve you or any related individual.

We will not share your personal data with third parties unless it is necessary for the purposes mentioned above and unless you provide your consent. These third parties may include FFAI’s business partners, subsidiaries, agents, and other external parties. Our third parties may also include government regulators, judicial and supervisory bodies, tax authorities, or courts with proper jurisdiction. We engage third parties for the following reasons:

1. Verify your personal information and fulfill legal obligations.
2. Enforcing our terms of use, including, but not limited to, our rights as a creditor to customers using our cash loan or credit products, or other relevant policies related to the services we provide.
3. Addressing fraud, responding to emergencies (e.g. calamities, pandemic and etc.), or otherwise safeguarding the rights, property, or security of our customers or third parties.
4. Accomplishing all other purposes mentioned above.

Personal data shared with third parties will be governed by the appropriate agreements to ensure that all data is adequately protected.

FFAI does not and will not sell personal data to any third party. All interactions with third parties will be fully compliant with our confidentiality obligations under applicable agreements, terms and conditions, or any relevant laws governing our relationship with you.

We strictly enforce data privacy and information security policies. We implement technical, organizational, and physical security measures to safeguard your personal data against loss, misuse, modification, unauthorized or accidental access, disclosure, alteration, or destruction. The following safeguards are in place:

1. We limit access to your personal data to qualified and authorized personnel who handle it with the utmost confidentiality.
2. We store and protect data on a secure server behind a firewall, using encryption on computing devices and implementing physical security measures.
3. We provide training to our employees on how to handle your data appropriately.
4. We require our third parties to safeguard personal data in accordance with our security standards.
5. We conduct privacy impact assessment to ensure that your data is secure and protected.

Personal data is stored in data centers (both on-premise and in the cloud) and physical document storage facilities.

We retain personal data only as needed for operational purposes and in compliance with legal and regulatory requirements. The retention period of your data approximately retain for five (5) years after the relevant processing has ended. However, the company may retain your data longer if necessary to establish, exercise, or defend legal claims, for legitimate business purposes, or as required by law.

You are responsible for ensuring that the personal data you submit to us is complete, accurate, truthful, and correct. Failure to do so may prevent us from providing the products and services you have requested.

If any information or personal data you have provided changes and becomes inaccurate, untrue, or incorrect, you should notify FFAI immediately and provide any necessary information or documentation that we may require to verify the accuracy of the updated data.

We also encourage you to be vigilant in safeguarding your personal data by keeping your account details, usernames, and passwords confidential and not writing them in places accessible to others. Please exercise caution to protect yourself against phishing, skimming, hacking,  and other forms of electronic fraud.

Under the Data Privacy Act, you have the following rights:

1. Right to object. For data processed based on your consent or the legitimate interest of the company, you may request the suspension, withdrawal, or deletion of your data from further processing. 2. Right to access. Upon submitting a written request, you have the right to access your data within reasonable limits. This may include details such as the content of the processed information, how it was processed, its sources, the recipients, and the purpose for which it was disclosed. 4. Right to erase or block. On reasonable grounds, you have the right to request the suspension, withdrawal, blocking, removal, or destruction of your data from the company’s filing system. However, this is without prejudice to the company’s continued processing of your data for commercial, operational, legal, or regulatory purposes. 5. Right to secure data portability. You have the right to request a copy of your data from the company in a commonly used electronic or structured format, in accordance with the company’s internal procedures. For inquiries, you may contact us at [email protected].
6. Right to be indemnified for damages. You have the right to be compensated for any damages resulting from a violation of your privacy rights due to inaccurate, false, unlawfully obtained, or unauthorized use of your data—provided that such violation is directly caused by the gross negligence, fraud, or willful misconduct of Flexi Finance Asia Inc., and that there is no contributory negligence, fault, or bad faith on your part or on the part of any third party outside the control of Flexi Finance Asia Inc. 7. Right to file a complaint. If you believe that your data has been misused, maliciously disclosed, improperly disposed of, or that any of your data privacy rights have been violated, you have the right to file a complaint with our Data Protection Officer (DPO) at [email protected] and/or with the National Privacy Commission (NPC) through privacy.gov.ph.

FFAI’s decisions to grant access, consider requests for correction or erasure, and address objections to the processing of data as it appears in FFAI’s official records are always governed by applicable internal policies, as well as relevant laws and regulations.

By submitting your data to FFAI, you confirm that you have read and understood this Privacy Notice and expressly consent to the processing of your personal and/or sensitive personal information in the manner and for the purposes outlined in this Notice.

You acknowledge and accept that this includes access to personal data and records submitted, which may be considered personal and/or sensitive personal data under the Data Privacy Act of 2012.

You also authorize FFAI to disclose your data to accredited or affiliated third parties, as well as independent or non-affiliated third parties, whether local or foreign, under the following circumstances:

1. As required for the effective execution of processes related to the stated purpose;
